In relation to (vehicle) in Ma'rib
Regarding the report issued by the Panel of the Experts on Yemen dated ( 26 January 2018 ) stated that an airstrike on (16 September 2017) hit a vehicle in (Ma'rib) causing the death of (12) people, also the report stated that the Coalition Forces used a (high-explosive) bomb or an (air-to-ground) missile in the attack.
JIAT verified the incident, examined all related documents, including the Procedures; Rules of Engagement, the Daily Mission Schedule, the After Mission Reports, the satellite images, the video recordings of the executed mission; and assessed all gathered evidence.
JIAT found that based on a request from the Land Forces to observe and target an armed vehicle during an engagement with the Houthi armed militia in a hostile operation zone in (Ma'rib), the Coalition Air Forces on (16 September 2017) executed an air mission on an (armed vehicle) located (80)km away west of (Marib) in an unpaved road on top of a mountain near (Shuja) village, (Harib al-Qaramish) area, (Marib) governorate, which is an area with no population and buildings.
JIAT found that the (claimed) vehicle was a single cap truck located in an armed clash zone on the road, which used as a supply line for the Houthi armed militia, and after the revaluation of the executed mission that carried out by the unit found out the target was a civilian single cap truck.
In light of this, JIAT found that the report issued on ( 26 January 2018 ) by the panel of the Experts on Yemen, that stated the Coalition Forces targeted a vehicle in Marib on (16 September 2017) was correct. JIAT recommends to present assistance for unintentional error in targeting the civilian single cap truck.
In relation to a (Traditional Market) in (Al haimia) Area, (Taiz) Governorate
Regarding the statement issued by the Humanitarian Coordinator on Yemen which stated that the initial reports issued by the office of the High Commissioner for Human Rights indicate that on (26 December 2017) airstrikes on a crowded traditional market in (Alhaima) area, (Atta'iziyah)District, (Taiz) Governorate, killed at least (54) civilians, including (8) children. Over the past few days, residential areas in (Alhaima) villages have been completely closed off by the (Houthi armed militia), indiscriminate bombardment, resulting casualties among the population, and displacement of many families.
JIAT verified the incident, examined all related documents, including the Procedures; Rules of Engagement, the Daily Mission Schedule, the After Mission Reports, the satellite images, the video recordings; and assessed all gathered evidence.
JIAT found that on (26 December 2017), and based on a request from the Land Forces the Coalition Air Forces executed an air mission on a target of gatherings of Houthi armed militia, and their vehicles located in the triangle of a road intersection between (Alhaima) villages west of (Sha'bAlmaleeh) village in (Taiz) Governorate, and poses a threat to the Land Forces of the Coalition Forces located in the area.
JIAT found that after reviewing the video recordings there were gatherings and vehicles of Houthi armed militia in the targeted location. Furthermore, the video recordings showed no evidence that the targeted location was a (traditional market), also the Coalition Forces took precautions before the attack by making sure that no civilians or civilian objects were existing in the targeted location.
In light of this, JIAT found that the Coalition Air Forces did not attack (traditional Market), and that the procedures of the Coalition in targeting the legitimate military target were carried out in accordance with the International Humanitarian Law and its Customary Rules.
