Legal Expert: What is published in the media about violations in prisons necessitates an investigation by the Public Prosecution Office

Baghdad Legal expert Ali Al-Tamimi said that what is published in the media about the existence of violations in prisons necessitates opening an investigation, especially by the Public Prosecution.

Al-Tamimi said in a statement that prisons in Iraq are subject, according to the Inmates and Depositors Reform Law 14 of 2018, to the oversight of the Public Prosecution, the Ministry of Human Rights, the General Inspectors Departments, the Commission for Human Rights, and any other legally empowered body, including Parliament, according to Article 61 of the Constitution, and prison administrations are also obligated according to this law to correct the inmates and depositors and rehabilitate them and create the appropriate atmosphere to re-enter society again.

He added that this law necessitated granting leave with conditions and exceptions, pointing out that prison overcrowding necessitates the expansion of building new prisons for the future and also requires the enactment of a new general amnesty law, especially after the end of the war with ISIS, pointing out that all countries of the world grant forgiveness and amnesty after the end of wars.

He stressed that the monitoring of prisons is carried out by the Public Prosecution, the Commission for Human Rights and Parliament through the inspection that they carry out, and they have the right to request the opening of an investigation in this regard, according to Law 14 of 2018, the Law on Inmates and Depositors.

He indicated that what was announced in the media about the existence of violations in prisons necessitated opening an investigation in this regard, especially from the Public Prosecution, and these actions can be called crimes against humanity because of the status of prisoners, as they are like prisoners without power or strength.
